I think there should be some contest-element in this...

But a new name also has many to do with the mission statement of the new project.

Miro does not have the name Mambo Copyrighted - it is only trademarked. The Word 'mambo' can not be copyrighted only the way they use it 'Mambo' along with its little flower logo... so in reality - we could use

'mambo open source' and a different logo.

Microsoft is not a word that the entire english language had before its inception - mambo is not owned by miro, simply trademarked....

Rebranding:
+ no association with miro
- Unknown name to the outside world
+ no need to renew text, documentation and domain names

No Rebranding:
- association with miro, possibly legal problems
+ widely known name

Looking at the above, rebranding means short term disadvantages, but long term advantages, while keeping the name works the other way around...

Not true.
They can trademark the name alone in the specific industry (e.g. Amazon).

It also depends on if anyone is likely to confuse the two different products.
I would say that is a big yes.

Anything with Mambo in the name is going to be a problem.

I think I may have suggested the name Tango for the Project Orange but I think Miro recently renamed their product to Jango.

That could be confusing = Tango CMS and Jango CMS.

Ive always liked the word "Phoenix" - it sounds mighty cool, and its general meaning seems pretty apt under these circumstances.

Can we please get only thing absolutely clear - there is no prospect of using the name 'Mambo' for this project at all.

The position on the Mambo trademark is that Miro's application in Australia is currently 'pending'.

Miro are seeking to trademark the names 'Mambo', 'Mambo CMS' and 'Mambo Siteserver' covering the industry areas of...

Class: 9  Computer hardware; computer peripherals; computer software including that for use in developing web sites or for use in storing and organising the content of web sites; database software; computer software for use in downloading, transmitting, receiving, composing, editing, extracting, encoding, decoding, playing, storing and organising data including written, pictorial, photographic, audio and video data; user manuals for use with the foregoing

Class: 35 Provision of computer database and on-line information services relating to management of data on web sites

Class: 38 Communication by computer, computer intercommunication; rental, hire and leasing of communications apparatus and of electronic mail-boxes; electronic transmission of data and documents via the Internet or other databases; delivery of data and messages by electronic transmission; providing access to an electronic computer bulletin board

Of particular interest here is that the trademark application for 'Mambo' alone rather than for 'Mambo CMS' and 'Mambo Siteserver' dates to March 2005 - the other applications were filed in March 2004.

The other interesting point is that the generic application for the trademark for 'Mambo' is the only one to include Class 35 which, if granted gives Miro the exclusive ownership of the Mambo name for any web-based, database driven software application, including the CMS, components and anything else similar - once approved one couldn't even, for example, develop a wholly different application, say a PHPBB-style standalone forum application and use the name Mambo for it.

Having broken with Mambo, any use of the Mambo name in future is a complete non-starter unless someone is prepared to opposed Miro's current trademark applications, which will require a lawyer and far bit of cash.

A new name for this project is, therefore, an absolute requirement- reverting to 'Mambo Open Source' is simply not an option.

Sorry, that's just the way it is folks.

Hey everyone,

I think the name should be taken seriously.  I'm still reeling here, and with 30 clients that are about to get the news that the community is under attack, the last think I need is any reference to "fork" or other dining utensils!

I think that Tango is a great name because it shows a new face, without any anger in it, but with relationship to the old mambo.  That's important to keep the community, clients, and press engaged with the dev team.

I really hope that this name does not come about quickly, and is produced under anger.  Let's try to push forward as if the name were for a brand new code base.

Please help us mambo developer shops keep good repoires with our clients who love Mambo!

MOS - Machine Operating System - can we keep off the acronyms, perhaps. OSM for 'OpenSourceMatters' is good but a product called OSM MOS? doesn;t work for me...

Fibonacci - sounds too much like a piece of specialist Math's software

Melody - has potential

Jambo - sells ringtones with irritating frogs

Salsa - not sure, I'm old enough to remember the early days when, thanks to Apple, the world and his missus would name just about any new computer firm after a piece of friut - whole got to be a joke and looked completely unprofessional after a while.

Mambo Open Source - not and option - see my last post

Freed

Tango - see 'Salsa' but admittedly a better name

FreeCMS - sounds like a noobie project that's been registered on sourceforge for all of a fortnight

Phoenix - doesn't just sound like a Mozilla project, it WAS a mozilla project - the previous name of Firefox - which was also 'Firebird' in between the two - a quick check showed that Mozilla dropped the Phoenix name for 'undisclosed legal reasons' which suggests there may be a trademark issue with this name.

OSM - keep it as a acronym for 'OpenSourceMatters' and go for a separate product name.

Come on, no one would use "Phoenix", it is trademarked by a big company producing PC BIOSes...
