Is article created with pre-selected category published immediately by design?

Hi,
Can I check if this is by design?

(The user has permissions on their article category to Create, Delete, Edit, Edite State, Edit Own.)

From a front-end perspective, If a menu item is made that creates an article in their category with their category preselected, the article is immediately published.
If the menu item is set to create an article without any category selected, and they are left to select their own category manually, the article is left for moderation (not published).

It seems the publishing state of the article is treated differently depending on whether the category was pre-selected or not?

With the Edite State Permission, the Article will be published by default.

Thanks. How come if they have edit state and select the same category it doesn't auto-publish when the only difference is they have selected the category themselves? Is it for a failsafe?
If they tried to publish an article to another category they do not have create permissions to, I'd expect that to be moderated / saved unpublished.

I want to offer menu items that allow a front-end user to create articles under a certain category. The category they use contains subcategories. Because of that, I can't use the create article menu item with a category preselected, as it only allows one category.so I wanted to leave the 'create article' menu item category blank allowing the user to select the category themselves, and have their article automatically published.

They should be able to select Published before saving.
