Dear Sir/Madam,

To introduce you about myself my name is Swapnil Gavai. I am actively involved in projects on Joomla and Joomla related websites. I reside in Kalyan which is a city located approximately 80 Km from Mumbai (INDIA)and one of the closest commercial hub to Mumbai. Kalyan is a city with lot of development activities and one of the major projects which big companies are investing and undertaking are the Shopping malls. Infact Kalyan now hosts the biggest shopping malls in India .



To my surprise I recently found out that these shopping mall known as “Metro Mall” located in Kalyan (address:metro mall,kalyan east,mumbai,INDIA, 421301)has copied the Joomla logo without mentioning any name or giving credit to the Joomla developers communities. As a responsible person I am myself very much annoyed by the copyright violations by the companies which are undertaking these projects of high magnitude. To give you the detailed information and proofs please find attached pictures for your kind perusal.



I was wondering if there are any policies which Joomla developers or users should abide by in order to copy logo like this to make profits from, or is it possible to copy the logo without any problems from the Joomla community. This mail is just to bring these and similar issues to your notice. And I would also like to know laws which mention these issues. I therefore kindly request you to send me the appropriate information in this regard.

i did ntoice one thing, the shops logo goes red, orange, blue and Joomla goes red, blue, green.. so its not quite a blatent copy but enopugh to be confusing. a trademark claim could be take.. wonder if there website is buily in joomla?

If it was in the Netherlands or the US I would start by sending them a letter from my lawyer. Mostly for fun.

Probably the mall doesn't know, they must have gotten this from a designer? So if you tell the mall they will get pissed at the "designer". Probably...

In following up on this we got a report that there may be a similar use at another mall or store in India. If anyone sees that please PM me.

This truly sucks...

Not because of the Joomla! involvement but due to the involvement, another time, of an open source project.

Still lot of people, around the world, think that OS means "for free and for everything you need".

Hope this stuff will be solved without any trouble.

We have engaged counsel in India and that firm is taking all necessary actions.
When we have more specific news that we can share I will post it.
As you probably know, with legal actions, anytime you comment publicly that becomes part of the record and makes the case more complex. As a result we are pretty limited in what we can say.


We do not have a new trademark policy. The only new thing that has happened recently is that JED has announced that older listings must come into compliance with our existing policy.

Look forward to hearing more when the time is right. We had a clothing company in India print some clothing for us, the end result was they then continued to print the clothing and onsell it directly. It was an interesting process to say the least to stop this.

No, no change at all except adding a simpler separate form for extension names. We just announced that we were clearing up old unresolved issues in the JED, just as we regularly do whenever we come across unregistered uses. In this case we felt it important to tell people that we are starting on a systematic project to do this so they have a chance to self-register and wouldn't feel singled out.

Please do not expect a "play-by-play" response from OSM on this matter. After this has been taken care of and all of the smoke clears, then we may get all the info. Until then, as Elin said, this is an ongoing matter and technically anything they write on this forum about the matter could be used against us (Joomla! Project).

I want to know all the details as much as anyone else, but that is just the way it is. We have to wait. :)
